Terms of Service

These Terms of Service ("Terms") are an agreement between you and World Wild Web LLC ("World Wild Web," "we," "us," or "our"), a limited liability company organized under the laws of the State of Delaware, United States. They govern your use of our website and any products or services we provide that reference these Terms (collectively, the "Services").
1. Acceptance of These Terms
By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy and Acceptable Use Policy, which are incorporated by reference. If you do not agree, do not use the Services. If you use the Services on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" refers to that entity.
You must be at least 18 years old, or the age of majority in your jurisdiction, to enter into these Terms.
2. The Services
World Wild Web designs, develops, and operates digital products, and provides related engineering and consulting services. Specific client engagements are governed by a separate written agreement (such as a statement of work or services agreement); if there is a conflict between that agreement and these Terms, the separate agreement controls for that engagement. Individual products we operate may have their own supplemental terms presented within the product.
We may modify, suspend, or discontinue any part of the Services at any time. Where a change materially affects a paid service you are actively receiving, we will provide reasonable notice.
3. Payments
- Fees. Fees for services are stated in the applicable order, proposal, or product checkout, in US dollars unless otherwise specified.
- Processing. Payments are processed by third-party payment processors such as Stripe. By submitting payment information, you authorize us and our processor to charge the applicable fees to your selected payment method.
- Taxes. Fees are exclusive of taxes. You are responsible for any applicable sales, use, VAT, or similar taxes, other than taxes on our income.
- Late amounts. Undisputed amounts not paid when due may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law.
- Refunds and cancellations. Cancellations, refunds, and billing disputes are handled as described in our Refund & Cancellation Policy, which is incorporated into these Terms. Except as provided there, in a separate agreement, or as required by law, fees are non-refundable once the corresponding services have been performed or the product delivered.
4. Intellectual Property
The Services — including our website, products, software, designs, text, and branding — are owned by World Wild Web or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Services, or reverse engineer any software within them, except to the extent applicable law permits it notwithstanding this restriction.
Ownership of deliverables created under a client engagement is defined in the applicable written agreement for that engagement. If you provide us feedback or suggestions, we may use them without restriction or obligation to you.
5. Your Obligations
You agree to:
- Provide accurate information when contacting us, creating an account, or making a purchase, and keep it up to date;
- Keep any account credentials confidential and notify us promptly of any unauthorized use;
- Use the Services in compliance with applicable laws and with our Acceptable Use Policy;
- Not interfere with or disrupt the Services, attempt to gain unauthorized access to systems or data, or misuse the Services in any way.
If you submit content to a product we operate, you retain your rights in it and grant us the license needed to host, display, and operate that content within the product. You are responsible for having the rights to anything you submit.
6. Third-Party Services
The Services may link to or interoperate with third-party websites and services we do not control. We are not responsible for their content, policies, or practices, and your use of them is governed by their own terms.
7. Disclaimers
EXCEPT AS EXPRESSLY SET OUT IN A SEPARATE WRITTEN AGREEMENT, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) IN NO EVENT WILL WORLD WILD WEB OR ITS MEMBERS, MANAGERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND (ii) ONE HUNDRED US DOLLARS (US $100).
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or willful misconduct.
9. Indemnification
You will indemnify and hold harmless World Wild Web from and against claims, damages, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the Services, or your violation of applicable law or third-party rights.
10. Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services if you breach these Terms, if required by law, or if we discontinue the Services, and — where practicable — will provide reasonable notice. Sections that by their nature should survive termination (including Sections 4 and 7 through 12) survive.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.
Before filing a claim, you agree to first contact us at hemant.parihar264@gmail.com and make a good-faith effort to resolve the dispute informally within 30 days. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in the State of Delaware, and each party consents to their jurisdiction and venue. Each party waives any right to a jury trial to the extent permitted by law. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the current version. For material changes we will provide reasonable notice, such as a notice on this website. Changes apply prospectively; your continued use of the Services after changes take effect constitutes acceptance.
13. General
These Terms, together with the policies incorporated by reference and any separate written agreement between you and us, are the entire agreement regarding the Services. If any provision is found unenforceable, the remainder stays in effect, and the provision will be enforced to the maximum extent permissible. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
